The jury deliberated for approximately one hour after the one-day jury trial.
The investigation began on Aug. 6, 2017 while Officer Cody Foust was patrolling for the Medaryville Police Department and observed Conley, who appeared to be passing out on a porch in the 200 block of East Maple Street in Medaryville. Officer Foust approached Conley to conduct a welfare check. As he approached the porch, he detected the odor of synthetic marijuana, or “spice,” and observed a roach in Conley’s hand that she tried to conceal. He instructed her to drop the object in her hand on the ground directly in front of her on the porch. However, instead of following the officer’s instructions, she quickly tossed the roach off the side of the porch into an overgrown grassy area. The officer was unable to recover the roach because of Conley’s actions. The officer, additionally, observed Conley exhibit several signs of intoxication during the encounter, which was captured and recorded on his body camera.
The jury heard testimony from Officer Foust and was provided the body camera footage from the incident.
Chief Deputy Prosecutor, Kelly Gaumer, prosecuted the case and attorney, Richard Ballard, represented Conley.
The case is scheduled for sentencing hearing on May 14, in Pulaski County Superior Court.
